2. Subject
This document regulates the conditions for using the website and concluding distance contracts between MIAGINI SRL ("Seller") and persons placing orders on the website ("Client"/"Consumer"), in accordance with Law no. 365/2002 on electronic commerce, GEO no. 34/2014 on consumer rights, and the Civil Code.
Using the website and placing an order implies full acceptance of these terms.
3. Products and prices
Prices displayed on the website are expressed in RON (Romanian Lei), include VAT, and may be modified without prior notice, with changes not affecting already confirmed orders. The Seller makes reasonable efforts to ensure the accuracy of product descriptions but cannot be held liable for minor technical display errors.
4. Order and contract conclusion
An order placed through the website constitutes an offer to purchase. The contract is considered concluded at the moment of order confirmation by the Seller (via e-mail or SMS). The Client is obligated to provide correct and complete data when placing an order.
5. Payment methods
Payment can be made through the methods displayed during the order completion process (online bank card, cash on delivery, bank transfer, etc., as applicable).
6. Delivery
Delivery is carried out by courier/post, to the address indicated by the Client, within the term communicated upon order completion. The risk of loss or damage to products passes to the Client at the time of physical receipt of the package.
7. Right of withdrawal
The consumer benefits from the right to withdraw from the contract, without penalties and without giving a reason, within 14 calendar days, according to GEO no. 34/2014. 8. Warranties and conformity
Products benefit from the 2-year legal conformity warranty, according to Law no. 449/2003 and the Civil Code. Any additional commercial warranties offered by the manufacturer do not affect the consumer's legal rights.
9. Liability
The Seller is not liable for indirect damages resulting from the use or inability to use the website, except in situations imperatively provided by law.
10. Intellectual property
The content of the website (texts, images, logo, structure) is the property of MIAGINI SRL or its partners and may not be reproduced without prior written consent.
11. Dispute resolution
In case of dissatisfaction, the Client can contact the Seller at sale@miagini.ro. Consumers have the right to address:
- The National Authority for Consumer Protection (ANPC) — www.anpc.ro;
- The European Online Dispute Resolution (ODR) platform — https://ec.europa.eu/consumers/odr;
- competent courts of law.
12. Applicable law
This document is governed by Romanian law.
13. Amendments
The Seller reserves the right to amend these terms; orders already placed are subject to the terms in force at the time of placing.
